Terms of Service Agreement

DotAnything.NET agrees to furnish web hosting services to the Subscriber, subject to the following Terms of Service (TOS) and DotAnything.NET's Acceptable Use Policy (AUP). Please be sure to read both documents before becoming a DotAnything.NET Subscriber.

The provisions of the TOS and the AUP may be changed, at the sole discretion of DotAnything.NET, from time to time and without previous notice to the subscriber or customer. Each Subscriber understands that changes by DotAnything.NET shall not be grounds for early contract termination or non-payment.

1.) Cancellation and Refunds

This Agreement may be terminated:

(i) by you or DotAnything.NET during any Renewal Term, without cause, by giving the other party written notice no less than seven (7) days prior expiration;

(ii) by DotAnything.NET in the event of nonpayment by you as provided in the section below or

(iii) by DotAnything.NET, at any time, without notice, if, in DotAnything.NET's sole judgment, you are in violation of any terms or conditions of the Acceptable Use Policy. If you terminate this Agreement, or if DotAnything.NET terminates this Agreement for your breach, before the end of the Initial Term or the Renewal Term, whichever is then applicable, you will be required to pay immediately and without setoff or delay all charges, fees and costs accrued before the termination date, all monthly recurring fees for each month remaining in the Term and any other amounts including, but not limited to, bandwidth overage charges that you owe to DotAnything.NET under this Agreement.

If the customer cancels service after the initial 30 days for any reason, all charges for that period are considered earned for all tasks and services DotAnything.NET is to perform, there will not be a refund for the remaining 'unused' time.

2.) Money back Guarantee

DotAnything.NET offers unconditional money back guarantee on our hosting services. Domain names registered through our services will be subject to a $7.95/ year domain registration fee. Should you decide to cancel your account within the initial 30 day period, you will receive a full refund on the hosting fees. The registration fees cannot be cancelled, however arrangements can be made to transfer the domain name to your new provider. Therefore, the registration service fees are non-refundable.
There are no refunds on dedicated servers.

Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, or if you have opened a second account with us, you will not be eligible for a refund.

3.) Payment

You agree to supply appropriate payment for the services received from DotAnything.NET, in advance of the time period during which such services are provided. You agree that until and unless you notify DotAnything.NET of your desire to cancel any or all services received, those services will be billed on a recurring basis.

There are no fees to upgrade/downgrade your account. If you are upgrading to a higher cost plan, your current billing cycle will be prorated. If you are downgrading to a lower cost plan, your current billing cycle will be given a prorated credit.

Choosing to pay by credit card authorizes DotAnything.NET to bill your card when the account is due.

Service will be automatically interrupted on accounts that reach 10 days past due.

DotAnything.NET reserves the right to change the monthly payment amount and any other charges at anytime.

4.) Account Setup

DotAnything.NET will setup your account after receiving your payment and DotAnything.NET and/or its payment partner(s) have screened the order(s) for fraud. This process usually takes less than a few minutes, but depending on the fraud screening process, it might take up to 8 hours. It is your responsibility to provide DotAnything.NET with an email address which is not @ the domain(s) you are signing up under.

5.) Your Privacy

You are required to enter internet contact information when ordering services from our site, or when establishing a domain registration account.
This information allows us to process payments and protect users from fraud. In some cases, we may also ask you to send us additional information or to answer additional questions to help verify your information.

Our internal staff and our direct agents, such as our credit card authorization service will have access to your contact information.

Please note that credit card numbers stored by DotAnything.NET are kept in encrypted format ONLY and are only ever accessed via a 128 bit SSL encrypted connection.

We will not share your personally identifying information with these third parties, other than service providers, unless we have your explicit permission to do so. For domain registration account establishment your information will be shared with our registration partner(s). As with any credit card payment, if you process a credit card transaction through the service, we need to share some information (for example, your name and credit card number) with the banks and other entities in the financial system that process credit card transactions. In both cases this is done over an SSL encrypted connection to their servers.

Bottom line: we have gone to extreme lengths to secure your credit card number, and it is in far more danger when you hand over your card in a restaurant. We do not store your CVV2 number as it is illegal to do so.

The security of your account also depends on keeping your account password confidential, and you should not share your account name or password with anyone. If you do share your account information with a third party, they will have access to your account and your personal information.

7.) Content

All services provided by DotAnything.NET may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene, child pornography. The customer agrees to indemnify and hold harmless DotAnything.NET from any claims resulting from the use of our services.

8.) Zero Tolerance Spam Policy

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double optin" will be treated as spam. Any user who sends out spam will have their account terminated without notice.

DotAnything.NET reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. DotAnything.NET also reserves the right to make any such modifications in an emergency at our sole discretion.

DotAnything.NET reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of DotAnything.NET. All rights reserved.

9.) Backups and Data Loss

Even though DotAnything.NET backs up the data regularly, Your use of the service is at your sole risk. DotAnything.NET will provide you with the tools to backup your files and databases. DotAnything.NET is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on DotAnything.NET servers.

10.) Resource Usage

Users may not initiate the following:

a) Use 25% or more of system resources for longer than 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.

b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.

c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.

d) Run any software that interfaces with an IRC (Internet Relay Chat) network.

e)Run any bit torrent

f) Run any gaming servers such as counter-strike, half-life, battlefield1492, etc

11.) Bandwidth Usage

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

12.) Price Change

We reserve the right to change prices listed on DotAnything.NET's website, and the right to increase or lower the amount of resources given to plans at any time.

13.) Indemnification

Customer agrees that it shall defend, indemnify, save and hold DotAnything.NET harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against DotAnything.NET, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless DotAnything.NET against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with DotAnything.NET; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from DotAnything.NET's server.

14.) Disclaimer

DotAnything.NET will not be responsible for any damages your business may suffer. DotAnything.NET makes no warranties of any kind, expressed or implied for services we provide. DotAnything.NET disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by DotAnything.NET and its employees.

15.) Reselling

Shared accounts can not resell web hosting to other people, if you wish to resell hosting you must use a reseller account.

16.) Changes to the TOS

DotAnything.NET reserves the right to revise its policies at any time without notice.
